These Terms govern your use of Max VPN. Please read them carefully. By using the app, you agree to be bound by them.

Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you ("you") and Max VPN ("we", "us"). By downloading, installing, or using the Max VPN mobile application (the "App") and the related VPN service (together, the "Service"), you agree to these Terms and to our Privacy Statement.

If you do not agree to these Terms, do not use the Service.

You also agree to comply with the Apple App Store's Licensed Application End User License Agreement, which applies to all apps distributed through the App Store.

The Service

The Service provides a virtual private network ("VPN") that encrypts your internet connection and routes it through one of our servers. The Service consists of:

  • The App, distributed through the Apple App Store.
  • A network of servers operated by us or our infrastructure providers.
  • Standard VPN protocols (such as IKEv2 or WireGuard) used to establish a secure tunnel.

The Service is provided on an "as available" basis. We make commercially reasonable efforts to keep it operational, but we do not warrant uninterrupted availability. Routine maintenance, regional outages, and updates are normal aspects of operating an internet service.

Note: A VPN protects the confidentiality of network traffic in transit. It does not, by itself, defend against malware, phishing, or insecure practices on your part. The VPN is one tool among several that contribute to your overall online safety.

Eligibility and Account

You must be at least 17 years of age, or the minimum age required to enter into a binding contract in your jurisdiction (whichever is greater), to use the Service.

The App uses an anonymous on-device identifier and an Apple In-App Purchase receipt to verify your subscription. You do not need to register an email address or create a password to use the Service.

You are responsible for maintaining control of the device on which the App is installed and for any use of the Service made through that device.

Subscriptions and Billing

The Service is offered through one or more subscription plans available for purchase inside the App. The current plans, prices, and durations are shown in the App at the time of purchase.

Payment

All payments are processed by Apple through In-App Purchase. Payment will be charged to your Apple ID at confirmation of purchase, in accordance with Apple's terms.

Auto-renewal

Subscriptions automatically renew at the end of each billing period unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple ID will be charged for the renewal within 24 hours before the end of the current period at the price disclosed in the App.

How to manage or cancel

You can manage your subscription, change plans, or turn off auto-renewal in the iOS Settings app, under your Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period; you continue to have access to the Service until then.

Refunds

Refunds for App Store purchases are issued by Apple, not by us, in accordance with Apple's refund policies. To request a refund, visit reportaproblem.apple.com and sign in with your Apple ID, or contact Apple Support directly.

We do not have the ability to issue refunds for In-App Purchases on Apple's behalf. If Apple grants you a refund, your access to paid features of the Service may be terminated immediately.

Acceptable Use

You agree to use the Service only for lawful purposes. You may not use the Service to:

  1. Violate any applicable law or regulation.
  2. Infringe the intellectual property rights of others.
  3. Distribute malware, viruses, or other harmful code.
  4. Send unsolicited bulk communications ("spam").
  5. Conduct denial-of-service attacks, port scans, or other network attacks.
  6. Engage in fraud, harassment, stalking, or threats against any person.
  7. Distribute or access child sexual abuse material (CSAM). This is grounds for immediate, permanent termination.
  8. Resell, sublicense, or commercially redistribute access to the Service without our prior written consent.
  9. Attempt to gain unauthorised access to our systems, or to interfere with their integrity or performance.

We may suspend or terminate access if we have a reasonable basis to believe that you have violated this section.

Intellectual Property

The App and the Service, including all software, trademarks, logos, and content (excluding content you provide), are the property of Max VPN or its licensors and are protected by intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App for your personal, non-commercial use on devices you own or control, in accordance with the rules of the Apple App Store. You may not copy, modify, distribute, sell, lease, or reverse-engineer the App or any part of the Service, except where applicable law expressly permits.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.

We do not warrant that the Service will be uninterrupted, error-free, or secure against every possible threat. We do not warrant that use of the Service will defeat any specific form of surveillance or attack.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, our warranties are limited to the minimum extent permitted by law.

Limitation of Liability

To the maximum extent permitted by applicable law, our aggregate liability to you in connection with these Terms or the Service, regardless of the legal theory, is limited to the greater of:

  1. The total amount you paid for the Service in the twelve (12) months preceding the event giving rise to the claim; or
  2. Fifty United States Dollars (USD 50).

In no event will we be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or loss of goodwill, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits any liability that cannot lawfully be limited.

Termination

You may stop using the Service at any time by uninstalling the App and cancelling your subscription as described in § 04. Cancellation does not entitle you to a pro-rated refund except as set out in § 05.

We may suspend or terminate your access to the Service if we reasonably determine that you have materially breached these Terms. Where practicable, we will provide notice and an opportunity to cure, except in cases involving § 06(7) or other conduct that requires immediate action.

Sections 07, 08, 09, 11, and any other provisions which by their nature should survive, will survive termination.

Governing Law

These Terms shall be governed by and construed in accordance with applicable law. To the extent permitted by law, any dispute arising out of or in connection with these Terms shall first be addressed by good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation, it shall be resolved by the competent courts of the jurisdiction in which the Service is operated.

Nothing in this section limits any statutory rights you have as a consumer in your country of residence that cannot be waived by contract. If any provision of these Terms is found unenforceable in your jurisdiction, the remaining provisions shall remain in full force and effect.

Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App before they take effect. The "Effective" date at the top of this page reflects the most recent change. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Service and cancel your subscription.
